1. Introduction

Welcome to HostingGen! These Terms and Conditions (“Terms”) govern your use of the website https://hostinggen.com/ and the services provided by HostingGen (“we,” “us,” or “our”).

By purchasing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these terms, you must not use our services.

2. Account Eligibility and Security

• Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process. Using fake names, addresses, or phone numbers may result in immediate account termination.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials (email, password, and 2FA). You are fully responsible for all activities that occur under your account.
• Age Restriction: You must be at least 18 years of age to register for and use our services.

3. Acceptable Use Policy (AUP)

Since our infrastructure utilizes Google Cloud Platform (GCP), we maintain a strict zero-tolerance policy against abuse to ensure the stability of our network.

You agree NOT to use our services for:

• Phishing & Fraud: Hosting fake banking sites, scam pages, or any attempt to steal user data.
• Spam: Sending unsolicited bulk emails (SPAM) or hosting content advertised via spam.
• Malware: Distributing viruses, worms, trojans, or any malicious code.
• Illegal Content: Hosting copyrighted material without permission (dmca), child exploitation content, or content that promotes violence/terrorism.
• Resource Abuse: Running scripts that consume excessive CPU/RAM (e.g., Crypto Mining, heavy background bots) on shared hosting environments.

Violation Consequence: We reserve the right to suspend or terminate any account found violating these rules without notice and without refund.

4. Payments, Renewals, and Billing

• Payment Methods: We accept major Credit/Debit cards and Mobile Banking methods (specifically bKash, Nagad, Rocket).
• Payment Due Date: Invoices are generated 7-14 days before the due date. You must pay by the due date to ensure service continuity.
• Late Fees: A late fee may be applied to invoices unpaid 3 days after the due date.
• Suspension & Termination:
  • Suspension: Accounts are automatically suspended if payment is not received within 3 days after the due date.
  • Termination: Accounts are terminated (and all data permanently deleted) if payment is not received within 30 days after the due date. Deleted data cannot be recovered.

5. Refunds

Our refund practices are governed by our separate Refund Policy. Generally, we offer a 30-day money-back guarantee for web hosting services. Domain registrations, SSL certificates, and software licenses are non-refundable.

6. Backups and Data Loss

• Your Responsibility: You acknowledge that you are solely responsible for maintaining independent backups of your website files, databases, and emails.
• Our Backups: While we may perform courtesy system backups, we do not guarantee the availability or integrity of these backups. HostingGen shall not be held liable for any loss of data caused by hardware failure, human error, or account termination.

7. Resource Usage (Shared Hosting)

To ensure fair performance for all clients on a server:

• Users may not exceed the resource limits (CPU, RAM, I/O) defined in their specific plan.
• We reserve the right to temporarily suspend sites that are causing server instability due to high resource usage. In such cases, we will work with you to upgrade to a suitable plan (e.g., VPS or Dedicated).

8. Limitation of Liability

In no event will HostingGen, its directors, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

1. Errors, mistakes, or inaccuracies of content.
2. Personal injury or property damage resulting from your access to our services.
3. Any unauthorized access to our secure servers.
4. Interruption or cessation of transmission to or from our services.

9. Third-Party Services

We may act as a reseller or license provider for third-party services (e.g., Domain Registrars, cPanel, Google Cloud). You agree to be bound by the terms and conditions of these third-party providers where applicable.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Dhaka, Bangladesh.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will attempt to notify you of significant changes via email, but it is your responsibility to review this page periodically. Continued use of the service after changes constitutes acceptance of the new terms.
